Severance and Consent Through Elgin County's Land Division Committee

Elgin County uses a single county-level Land Division Committee to decide severance and consent applications for all seven of its lower-tier municipalities. The application requires Appendix B, certified by the local municipal clerk, listing everyone assessed within 60 metres of the subject property for circulation purposes. The current application fee is $3,340. Once a complete application is accepted, the Committee holds a public hearing and issues its decision immediately afterward, with formal notice following within 15 days. A 20-day appeal period to the Ontario Land Tribunal follows, and approved consents generally carry a two-year window to fulfill conditions and register the deed. The Parkland Dedication Requirement, Explained

Under Sections 42 and 53(12) of the Planning Act, a municipality can require parkland, or cash in place of it, as a condition of a severance. Where an Elgin County municipality applies a flat rate for rural severances, no appraisal is needed. Where cash-in-lieu is assessed case by case, the payment is based on the appraised value of the land that would otherwise have been dedicated, and RealEx prepares that valuation directly, in a format that holds up if the amount is disputed before the Ontario Land Tribunal.
